Code Enforcement


Listed are common violations along with ways to remedy the violation. If you have received a code compliance notice and you have questions beyond what is stated below, please contact Town Hall at 817-693-5280 or report a concern.


Address Number

Violation

Failing to have the address number placed on the front of the residence or in a location in plain view from the street. Address numbers must be at least 4 inches tall.


Example: No address number or address number only located on a mailbox that is on the opposite side of the street as the house.


Property Owner's Duty

The property owner shall install a weather-resistant address number on the front of the building, door, post, or other place that is clearly visible and legible from the street fronting such building. In such instances that the building is not in plain view from the street, the number shall be affixed to or painted on the mailbox, post, curb, fence or other such suitable surface on or near the property line nearest to the fronting street. The street address number shall be a minimum of at least three inches in height so as to be easily seen from the street and shall be of a contrasting color to the surface it is attached to.


High Grass / Weeds

Violation

Grass, weeds and brush growing to a height greater than 12 inches in the area within 25 feet from the center line of an abutting road creating a public nuisance.


Property Owner's Duty to Remove

The property owner shall abate the nuisance by mowing and removing such weeds and/or brush. Ultimately, if the property owner fails to abate the nuisance, the Town may perform the work required and file a lien against the property for the expenses and legal fees associated with the abatement.


Junk Vehicle

Violation

Allowing a junked vehicle, including part of a junked vehicle, to be visible from a public place or public right-of-way. A junked vehicle is a vehicle that does not have a valid license plate or inspection sticker and is wrecked, dismantled, partially dismantled, discarded or inoperable.


Examples: storing an inoperable trailer in a pasture; having a vehicle up on jacks in your driveway


Property Owner's Duty to Remove

The property owner shall abate the nuisance in one of the following manners:

  • Removing the junked vehicle from the property
  • Bringing the vehicle into compliance, including installing a valid license plate and inspection sticker and ensuring the vehicle is in working order
  • Completely enclosing the vehicle within a building and ensuring that it is not visible to public or private property

Outside Storage

Violation

Allowing the open storage of goods and materials of such quantity and type as to not be considered for personal use or consumption.


Examples: Several lawn mowers visible from the street; furniture and appliances stored on porches; storing work equipment or construction materials on trailers visible from the street.


Property Owner's Duty to Remove

The property owner shall remove all goods and materials from the property that are not to be used for personal use or consumption such as firewood, garden equipment, farm equipment, etc.


Signs

Violation

Allowing the placement of an illegal sign.


Examples of prohibited signs: Contractor signs remaining on the property after the work is completed; advertisement of off-premise activities; leaving a political sign up for more than 72 hours after the related election.


Property Owner's Duty to Remove

The property owner shall remove the illegal sign.


Trash

Violation

Allowing the accumulation of refuse, garbage, rubbish or junk creating a public nuisance.


Examples: Disposing of trash or old items on porches or on the property in a location visible from the street; setting trash out for regular pick-up with no account set up resulting in the trash remaining at the street for several days.


Property Owner's Duty to Remove

The property owner shall abate the nuisance by removing such refuse, garbage, rubbish and / or junk. Ultimately if the trash is not removed, the Town may hire someone to remove the trash and file a lien against the property for the expenses and legal fees associated with the abatement.
